Terms and Conditions of the tender for the work of “providing and applying water proof compound on sloped RCC roof quarters at CCRI, Balehonnur, Chikmagalore District”

Sealed percentage tenders for the tender work of “providing and applying water proof compound on sloped RCC roof quarters at CCRI, Balehonnur, Chikmagalore District will be received by the undersigned up to 3.00 p.m., on 25.05.2009. The sealed tenders will be opened on the last day of receipt of tenders at 4.00 p.m., in the presence of interested tenderers.
- 1. Tenders should be sent in sealed covers addressed to the “Estate Officer, Coffee Board, No.1, Dr. Ambedkar Road, Bangalore – 560 001” and super scribed as “Tender for the work of providing and applying water proof compound on sloped RCC roof quarters at CCRI, Balehonnur, Chikmagalore”.
- Each tender shall be accompanied by a Crossed Demand Draft for Rs.10,000/- (Rupees Ten thousand only) in favour of “Coffee Board General Fund A/c No.1” payable at Bangalore., drawn on any schedule Bank as Earnest Money Deposit, which will be returned to the tenders whose tenders are not accepted. The EMD of successful tenderer will be adjusted to security deposit of sum equal to 10% of the bill amount. This Security Deposit will not carry any interest. The Security Deposit will be refunded subject to satisfactory performance of the work & after six months from the date of completion of the work only after ascertaining that there are no defects in the executed work. Any rectification work involved within six months from the date of completion, the expenditure on rectification work will be debited to the tenderer’s account and would be recovered from amount due to the contractor either from this work or from any other work awarded by the Board.
- The tenderer shall enclose a copy of valid Registration certificate from CPWD / MES / State PWD / Appropriate authorities to show that they are the registered contractors of the required class, other wise the tenders will be rejected. The tenderer shall furnish a copy of the challan of latest Income tax payment, work done certificate from appropriate authority for works of similar nature & single work for amount not less than 50% of the amount put to tender in any of the last three years.
- Every tenderer before tendering may inspect the spot with regard to its nature, ground levels & rates of materials, surroundings so as to be fully acquainted with nature of the work and environment in which it has to be executed. No alteration shall be made by the tenderer to the tender conditions.
- If the tenderer feels any doubt as regard to the correct interpretation of any clause, he should submit the same in writing to the Estate Officer, Coffee Board, Bangalore and confirmation should accompany the tender or otherwise it will be presumed that the tenderer agrees with the Estate Officer, Coffee Board, Bangalore in his standard interpretation of the clauses and no different interpretation in the terms of the contract would be entertained, subsequent to award of contract during the period of execution of the work for completion of the work.
- The sealed tenders so received will be opened in the Head Office, Coffee Board, No.1, Dr. B.R.Ambedkar road, Bangalore – 560 001 by a Committee constituted for the purpose and in the presence of the interested tenderers or their representatives. The Chairman, Coffee Board reserves the right of rejecting all or any of the tenders without assigning any reason. Discretion to demand for bank guarantee for an amount equal to the amount quoted or part thereof, by the successful tenderer rests with the Chairman, Coffee Board.
- The successful tenderer will be required to execute an agreement with the Estate Officer, Coffee Board, Bangalore for the due fulfillment of the contract within seven days of the date of which the communication is made on acceptance of the tender in Rs.100/- non judicial stamp paper. Failure to comply with this will entail forfeiture of the Earnest Money.
- The work should be carried out by the contractor strictly according to CPWD/ISI specification. No part of the contract shall be sublet. Standard CPWD practice of measurements will be followed. The contract is not a lump sum contract. The Chairman does not accept any responsibility for the correctness or completeness of the schedule of probable quantities and payments will be made according to actual agreed measurements at contract rates. The schedule of probable quantities is liable to alterations by omissions or additions.
- The payment will be made only on presentation of bills in duplicate together with the measurements of actual work done. No advance payment on any account will be made. For all extra items of work carried out with the prior approval, the rates should always be negotiated and agreed upon before the work started. No increase in the quoted rates will be allowed either on account of increase in the cost of Labour or materials.
- The work should be completed within 45 days, from 3rd day after the date of issue of work order. Any delay in completion of the work results in inconvenience to the occupants of the staff quarters when it rains. In the event of the tenderer not showing adequate progress of the work, the Chairman, Coffee Board at his discretion may cancel the contract without assigning any reason and forfeit the Security Deposit or levy penalty for period of delay.
- The tender schedule is prepared based on CPWD DSR 2007 rates for civil works and market rates are considered for the non schedule items.
- In all the matters pertaining to the contract / tender and in the event of any disputes, the decision of the Chairman, Coffee Board shall be final. In any case, the jurisdiction of legal matters shall be within Bangalore.
